CREW2GO – Subcontractor Terms and Conditions

1. Definitions and Scope
1.1. “CREW2GO” refers to the platform operator connecting subcontractors to construction companies and recruitment agencies for short-term assignments.
1.2. “Subcontractor” refers to you, the individual registering and accepting work through CREW2GO, operating on a self-employed basis under the Construction Industry Scheme (CIS).
1.3. These Terms and Conditions govern your use of the CREW2GO platform and any work accepted through it.

2. Subcontractor Status
2.1. By registering with CREW2GO, you confirm that you are a self-employed subcontractor and not an employee, agent, or worker of CREW2GO or any hiring entity.
2.2. You are fully responsible for managing your own tax affairs, including any liabilities to HMRC under the CIS, National Insurance contributions, or VAT (if applicable).
2.3. Nothing in this agreement constitutes a contract of employment between you and CREW2GO.

3. Document Submission and Personal Information
3.1. You must upload accurate and valid identification, UTR (Unique Taxpayer Reference), Right to Work in the UK documents, and any industry certifications (e.g. CSCS cards) as required.
3.2. You are responsible for keeping your profile information up to date and accurate at all times.
3.3. Providing fraudulent, expired, or misleading documentation may result in immediate removal from the platform and may be reported to relevant authorities.
3.4. CREW2GO will securely store your personal data and only share it with hiring entities as necessary for compliance and vetting purposes, in line with our Privacy Policy.

4. Booking and Work Assignments
4.1. When you are booked for a job, you must attend punctually and perform the work diligently and professionally.
4.2. You may accept or decline jobs at your discretion. However, repeated cancellations, no-shows, or poor performance may result in suspension or deactivation of your profile.
4.3. You are responsible for providing your own tools, PPE, and transportation unless otherwise stated.

5. Payment Terms
5.1. CREW2GO processes payments for subcontractors under CIS, typically on a weekly basis subject to timesheet approval by the hiring party.
5.2. Delays in payment caused by late or disputed timesheets, hiring company insolvency, public holidays, or bank processing times are not the responsibility of CREW2GO.
5.3. You must ensure your bank details are correct. CREW2GO is not liable for lost or misdirected payments due to incorrect information provided by you.
5.4. If you are VAT-registered, you are responsible for issuing a valid invoice including reverse charge VAT wording. CREW2GO does not pay VAT directly to subcontractors where the domestic reverse charge applies.
5.5. CREW2GO reserves the right to deduct applicable CIS tax from gross payments where required by law.

6. Legal and Compliance Obligations
6.1. You confirm that you are legally entitled to work in the UK and that you meet the self-employment criteria under HMRC guidelines.
6.2. You agree to comply with all relevant health and safety laws, site regulations, and CREW2GO compliance protocols.
6.3. You agree not to share your login credentials or represent yourself fraudulently on the platform.

7. Disputes and Liability
7.1. In the event of a dispute between you and a hiring party, CREW2GO may, at its discretion, act as an intermediary; however, CREW2GO does not guarantee resolution and assumes no legal or financial responsibility for the outcome of any such dispute.
7.2. CREW2GO does not provide, arrange, or facilitate any form of insurance coverage on behalf of subcontractors, including but not limited to public liability insurance, accident insurance, sickness insurance, income protection, or tool and equipment insurance.
7.3. You are solely responsible for arranging and maintaining appropriate insurance coverage for all work undertaken through the CREW2GO platform. You agree that it is your responsibility to ensure you are adequately protected against any claims, losses, damages, liabilities, or injuries that may arise in the course of your services.
7.4. By using the CREW2GO platform, you expressly acknowledge and accept that CREW2GO bears no liability for any financial loss, personal injury, property damage, or third-party claims arising out of or in connection with the services you perform as a subcontractor.
7.5. CREW2GO expressly disclaims any and all liability to the fullest extent permitted by law, whether in contract, tort (including negligence), breach bof statutory duty, or otherwise, arising under or in connection with any services you provide under your subcontractor status.
7.6. CREW2GO is not liable for any financial loss, injury, illness, or site-related incidents arising from your work.
7.7. You are responsible for arranging your own public liability insurance and accident cover.
7.8. If you believe your CIS or VAT status is incorrectly applied, you must notify CREW2GO in writing immediately.

8. Force Majeure
8.1. CREW2GO is not liable for delays, cancellations, or non-payment resulting from events beyond our control, including but not limited to:
8.1.1. Pandemics
8.1.2. Natural disasters
8.1.3. Strikes
8.1.4. Acts of terrorism
8.1.5. Site closures due to public health emergencies

9. Termination
9.1. You may delete your account at any time by written request.
9.2. CREW2GO may suspend or terminate your account at its sole discretion in cases of non-compliance, fraud, or behaviour detrimental to the platform or hiring clients.

10. Acceptance
10.1. By registering with CREW2GO and accepting these Terms and Conditions, you confirm that:
10.1.1. You have read and understood all terms.
10.1.2. You accept full responsibility for your tax, legal, and operational obligations as a subcontractor.
10.1.3. You will comply with all applicable legislation and platform rules.
